Temporary funding for the Department of Homeland Security, which was included in the Consolidated Appropriations Act, 2026, expires next Friday, February 13. Democratic Congressional leadership prepared a letter to Republican Congressional leadership dated February 4 which includes a surprisingly good list of demands to constrain the terrible actions we’ve seen ICE and CBP undertake in our streets. These constraints include:
1. Targeted enforcement
2. No masks
3. Require ID
4. Protect sensitive locations
5. Stop racial profiling
6. Uphold use-of-force standards
7. Ensure state and local coordination and oversight
8. Build safeguards into the system
9. Body cameras for accountability, not tracking
10. No paramilitary police
The letter further says that to “show good faith” the administration should ramp down the surge in Minnesota and remove Kristi Noem.
The letter does not state that these restrictions are a prerequisite for funding DHS, either in a short-term funding bill or in a full-year appropriation, and it does not state that no additional funding will be provided for ICE.
Call to Action:
Contact Senators Klobuchar and Smith, and your Congressional representative, to demand that they vote “no” on any short-term or long-term funding for DHS unless it includes ALL of these constraints, does not provide any additional funds for ICE and CBP, and demands to remove all ICE agents from Minnesota.
